School Board Violates Open Meetings Law

I took the time to read the open meetings laws. On page 15 of a packet published by New York State School Boards Association titled, "School District Obligations Under the Open Meetings Law Fact and Fiction" it states


     2. An executive session can take place only upon a majority vote of the total membership of the board taken at an open meeting (Pub.      Off. Law § 105 (1)).
               a. Because it can be convened only upon a majority vote of the board in an open public meeting, a school board cannot schedule an executive session in advance (e.g. Executive Session at 6:30 p.m. and Public Meeting at 7:00 p.m.) (NYS Department of State, Committee on Open Government OML- AO-3339, July 23, 2001).

Since the Focus, a school publication, and the school board website publish that the School Board meetings begin at 7:30 and our school board schedules executive sessions in advance at 6:30 that they are in clear violation of the open meetings law.

It seems to me if a secret school board meeting were taped and distributed, this must have been the work of one of the members in attendance. Perhaps board solidarity is not so solid.

Author should think twice about censoring comments. This degrades the validity of the Blog. One can't cherry pick if effectiveness is to be realized

I'm having difficulty locating anyone who possesses a copy of the secretly taped Board meeting. Perhaps you could enlighten your readers on any worthwhile tidbits contained therein in addition to altering grades, and a plan to stun gun an outraged grandmother for daring to challenge their procedures. If that is the extent of the juice then let us know.

Ref today's Buff New article calling for officials' ouster. Things gets more and more intriguing! In addition to the plan to taser a private citizen we now have the wrongful termination of a teacher; info apparently gleaned from the allegedly illegally taped Board session. (Why isn't the Blogger addressing that tidbit?) I contend that there was no illegal taping. If the meeting time and location were known only to Board members, then one of them taped it. In fact, more than one member may have known this was occurring. The ongoing, relentless contention that the meeting was illegally taped is ludicrous. There is no way to prove this. (The Board doth protest too much, me thinks.) These people screwed up and got caught and are now playing the diversion/deflection game. I now believe there is, thankfully, at least one Board member with enough integrity to expose the ongoing injustice and I roundly applaud that individual. And pray tell, why has the district already exceeded their $30,000 legal fees budget? If the Board president and the Acting Super have to pay out of pocket for any wrongdoing on their part this is just deserts.

I would like to know why we have a school board anyway? What do they do besides lie? When IEP's are presented during the meeting what gives them the right to say yes or no? It is every child's legal right to get what they deserve regardless of their opinion anyway. There are laws for this....so who cares what they have to say anyway!!!!!!!

Did you see Greg Wichlacz at the Board meeting tonight? He walks around like he is a "big guy", but he looks like the Michilan Man. One word for you Greg, TREADMILL!

Here is a wonderful example of a Hamburg high School Graduate...If you read this young mans blog, which is openly posted on the internet..he mocks Hamburg and the teachers and staff who help this kid. He claims he ran the school, and had access to all AP scores. How does that feel Mr. Gallagher and Zogiab...u boys are mentioned. He mocks and scorns his teachers at Hamburg and then carries the same behavior to Fredonia, where he feels better than everyone else. What I laughed most about is his over inflated view of an internship at Entercom radio, WBEN this summer. I forwarded the blog to my that station. THis is a sick example of what Hamburg has produced...My daughter is at Fredonia College with this boy and told me about the things he says about Hamburg and now the same behavior at Fredonia. What a sick example of a Hamburg Gradurate. PLEASE READ THIS KIDS VIEW OF THE WORLD
