Resident of the School Dist. filed ARTICLE 78 CHARGES in the Supreme Court of New York State (12/23/10) against the District for ongoing violations of Civil Practice Laws and Rules (CPLR) and Public Offices Laws 10 and  100-111.  The Board violated Open Meeting Laws in several ways, and the Article 78 focuses on the illegal manner in which the Board schedules and enters into executive session prior to the posted time of the open meeting, enters into executive session without a majority vote of its total members in the open session, and fails to identify the general subject matter(s) that it tends to discuss during such closed meetings.  Furthermore, petitioner alleges the Board then ends the open meetings by reconvening into executive session with no provided reasons and then fails  to return to open meeting to properly adjourn their meetings.  Also, petitioner contends that Interim Superintendent Steve Achramovitch failed to take an oath of office before entering into the discharge of his duties and not within the five days of taking office.  The interim superintendent carried out the duties of interim superintendent from approximately August 31, 2010 until December 15, 2010 having not sworn an oath of office. (New York State Constitution, Article XIII, Section 1; Public Officers Law 10).

School Dist and Steve Achramovitch apparently doesn’t appear to follow sunshine laws ( Fed and State Open Meetings Laws) or New York State Education Law.

I feel like the Board does what ever they please and doesn't care about the staff. So it makes sense they hired Steven to figure out the budget. The BOE needs that extra cash for writing programs and Africa.

Does that mean any action taken by SA during his interim reign of terror could be made void by the courts? I think he started 8-17-10, btw. How the RSB be so stupid? Listen closely at the next BOE meetings, not only will their heads be bobbling, you may her the marbles inside rolling around. Where is the petition to get rid of him?

The Hamburg police have not asked QUESTIONS about who had been in the classrooom before and after that illegal meeting. They have no reason too and the BOE is in legal trouble. Sally opened the door and more will follow/file suit. Taxes allow the general public to decide how to run their schools, Not 3 to 8 idiots!

I really hope this leads to the end of the reign of terror, not just by Achromo, but by this horrible board as well. If not, their plans for destroying this district have only just begun. The public will be shocked and outraged by the cuts they are discussing. Why is this district supposedly in such a terrible financial position (again), anyway? If we truly are in financial trouble, why in the world are we paying this idiot $170,000 to run the district into the ground? I don't know what this BOE thinks it's doing, but it isn't in the best interest of the public.

TELL everyone that it only helps to attend Board Of Ed. meetings. One H.S. teacher use to have all of his students go for a class assignment. Students, Teachers, Parents, Staff, Tax Payers, and the General Public should all show their strength in numbers!

Acramo and the RSB shall persist in defying the rule of law until they are legally compelled to cease and desist. We are being exposed to a perfect example of power corrupting those who possess it. It appears that Achramo deems his $170,000 salary sufficient to bestow absolute supremacy; to wit: none must question his authority, the RSB must kneel reverently before him (no problem garnering compliance with that dictate), the law is an ass, the tape is illegal because he declares it so.

Kudos to that individual initiating the Article 78 action (although I can easily deduce the petitioner’s identity). To this valiant creature I say: perfer, obdura (hold out, be strong). Even though many may voice opposition, only the bravest are willing to embrace serious risks to correct wrongdoing. Those of us who oppose this reprehensible regime must provide aid and support as we are able through the completion of the Article 78 process.

Ok, so let me get this straight. A resident of the school district is filing charges on the super and the BOE. Essentially, she is filing on behalf of the taxpayers, since violation of the open meeting laws violates all of our rights. We, the taxpayers are paying for the legal defense of the BOE and the super. Isn't that a conflict of interest? I thought the district was "broke". If someone in the private sector was sued by his/her company, would the company pay the legal fees? I am simply asking b/c I don't know how all of this works, not trying to be sarcastic.

The minutes are ever more laughable. Its a big joke to the rub, except they haven't the souls to realize how many lives they have ruined. They are one sick bunch, with zero character.

go to other school district websites and look at their SB pages, download their minutes. Night and day compared to Hamburg. Read about other districts in the Buffalo News or other local papers. You can read that there is debate and even arguments about policy. I'd much rather head that people have a vigorous debate than what the RSB does.

To those of you who care about the upcoming budget. Call the Superintendent and get on the Ambassadors group. In years gone by this was a big lie session, and the members of the community were too caught up in the Mayberry image to ask serious questions, like about transferring money between budget lines. Or, the voodoo that the business manager uses. Someone with public finance background get on that committee. Apparently, having two members of the RSB with Banking background is of no good. Call Tomorrow. He already had one meeting. This year he is not allowing teachers or staff of the AMBASSADORS, only community members. HELP.. GET ON THAT COMMITTEE AND WATCH FOR THE HOCUS POCUS.

fadisersI know. I work for another district. We are sent, via email, the agenda before each meeting. The minutes are then posted promptly. (Hey - we even get a phone call /text when school is canceled)

As to no staff on the committee, what if they are tazpayers? Many of the staff live in Hamburg.
