Resident of the School Dist. filed ARTICLE 78 CHARGES in the Supreme Court of New York State (12/23/10) against the District for ongoing violations of Civil Practice Laws and Rules (CPLR) and Public Offices Laws 10 and 100-111. The Board violated Open Meeting Laws in several ways, and the Article 78 focuses on the illegal manner in which the Board schedules and enters into executive session prior to the posted time of the open meeting, enters into executive session without a majority vote of its total members in the open session, and fails to identify the general subject matter(s) that it tends to discuss during such closed meetings. Furthermore, petitioner alleges the Board then ends the open meetings by reconvening into executive session with no provided reasons and then fails to return to open meeting to properly adjourn their meetings. Also, petitioner contends that Interim Superintendent Steve Achramovitch failed to take an oath of office before entering into the discharge of his duties and not within the five days of taking office. The interim superintendent carried out the duties of interim superintendent from approximately August 31, 2010 until December 15, 2010 having not sworn an oath of office. School Dist and Steve Achramovitch apparently doesn’t appear to follow sunshine laws ( Fed and State Open Meetings Laws) or New York State Education Law.
