Clairvoyance of the Hamburg Schools Board of Education



How could the Superintendent and the Board of Education possibly pre-schedule executive sessions for all of the 11-12 BOE meetings? 


Does the Superintendent have a crystal ball which anticipates future events?

When can a meeting be closed?
    The law provides for closed or "executive" sessions under circumstances prescribed in the law. It is important to emphasize that an executive session is not separate from an open meeting, but rather is defined as a portion of an open meeting during which the public may be excluded.
    To close a meeting for executive session, the law requires that a public body take several procedural steps.
First, a motion must be made during an open meeting to enter into executive session; second, the motion must identify "the general area or areas of the subject or subjects to be considered;" and third, the motion must be carried by a majority vote of the total membership of a public body.
    Further, a public body cannot close its doors to the public to discuss the subject of its choice, for the law specifies and limits the subject matter that may appropriately be discussed in executive session. 



The eight subjects that may be discussed behind closed doors include:
    (a) matters which will imperil the public safety if disclosed;
    (b) any matter which may disclose the identity of a law enforcement agency or informer;
    (c) information relating to current or future investigation or prosecution of a criminal offense which would imperil effective law enforcement if disclosed;
    (d) discussions regarding proposed, pending or current litigation;
    (e) collective negotiations pursuant to Article 14 of the Civil Service Law (the Taylor Law);
    (f) the medical, financial, credit or employment history of a particular person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a particular person or corporation;
    (g) the preparation, grading or administration of examinations; and
    (h) the proposed acquisition, sale or lease of real property or the proposed acquisition of securities, or sale or exchange of securities held by such public body, but only when publicity would substantially affect the value thereof.
   
These are the only subjects that may be discussed behind closed doors; all other deliberations must be conducted during open meetings.
    It is important to point out that a public body can never vote to appropriate public monies during a closed session. Therefore, although most public bodies may vote during a properly convened executive session, any vote to appropriate public monies must be taken in public.
    The law also states that an executive session can be attended by members of the public body and any other persons authorized by the public body.

 "SCHOOL BOARD 2011-12 MEETING SCHEDULE The schedule for 2011-12 School Board meetings was set as follows:Aug. 16, Administration Building; Sept. 13, Middle School; Oct. 11, High School; Nov. 8, Boston Valley; Dec. 13, UnionPleasant; Jan. 10, Armor; Feb. 14, High School; March 13, Charlotte Avenue; April 17, Administration Building; May 1, HighSchool; May 8, Administration Building; June 12, Middle School. Budget work sessions are set for Nov. 15, Dec. 6, Jan. 24,Feb. 28, March 6, March 20 & April 3, all at the Administration Building. Board meetings will begin at 6:30 p.m., at which time it's anticipated that the board will adjourn into executive session, then return to regular session at 7:30 p.m. The annual budgetvote and School Board election will be on May 15.

In the words of the NYS Committee on Open Government:
"A public body cannot in my view schedule an executive session in advance of a meeting. In short, because a vote to enter into an executive session must be made and carried by a majority vote of the total membership during an open meeting, technically, it cannot be known in advance of that vote that the motion will indeed be approved. However, as an alternative method of achieving the desired result that would comply with the letter of the law, rather than scheduling an executive session, the Superintendent or the Board on its agenda or notice of a meeting could refer to or schedule a motion to enter into executive session to discuss certain subjects. Reference to a motion to conduct an executive session would not represent an assurance that an executive session would ensue, but rather that there is an intent to enter into an executive session by means of a vote to be taken during a meeting."


How can the Superintendent and the Hamburg Board of Education project which of the eight topics permissible for discussion in closed session will arise over the 11-12 school year?    What makes the BOE so sure that if a motion were made to go into executive session on the dates of the scheduled meetings, that in fact the majority would vote in favor in the motion?  Is the BOE and that Superintendent complying with NYS Open Meeting Laws?  In the opinion of this writer, the BOE is not in compliance with Open Meetings Laws.


Perhaps the BOE and Mr. Achramovitch should open a booth at The Fair next to Tiny Tina and read tea leaves.

There is a lot out there regarding Achramovitch. Facts regarding his behavior in Ken/Ton with a subordinate (a teacher while he was Supt.) Fact her husband at the time a teacher also in the dist. Fact the young teacher had a very young child with needs. Fact his wife divorced him and he busted up this other young family. Fact tried to use his position as Supt. of Ken/Ton to adversely affect his lovers husbands teaching job. Fact he is a well documented liar.

Go to a school board meeting and see for yourself the patterns. No discussion, you will leave clueless as to what was voted on (Concensus items.) Our surrounding districts do all their business in the open, only the items allowed under the open meeting laws are conducted in ex session. Some school districts are on Govt. access staions. Just imagine how foolish this board would appear if they would ever agree to be on television. The public should have the opportunity to see their govt in action. Democracy is all about public access and public participation, not closed door meetings. Get it right.

If the readers of this blog do not fully comprehend how "closed" hamburg is about doing buisiness, go check out other area BOE agenda's and minutes. In west seneca the agenda is emailed to the staff and those community members on the email list. EVERYTHING is laid out. The Minutes are posted withhin 48 hours. The meetings are held at the same central location and broadcasted on the public access channel. This is a district where the BOE, administration, and various unions actually try to work together b/c they recognize that the common goal is the students and their futures.

The RSB meeting was interesting on 8-16-11. District hired more over paid administrators. Achramo bumbled his way thru the trail of deception. And Calkins tried to run a meeting using Roberts Rules but cant quite live up to the job. An hour was wasted with someone looking for a tax break on historical buildings, but no ones ask what criteria is used to make a building historical. I live in a Hamburg Village post WWII Cape, my house is classic 1950s...very historic. Can I get a tax break if I keep it in 1950s drab? Hilarious when Achramo put up the overhead and typed in his username and password in front of 75 people. At one point, achramo rudely shut down hta president mrozek for trying to ask a question. be polite johnny and sit and listen. matt dils is better off keeping the marbles in his mouth....he makes no sense when he talks. he would be advised to keep his bumbling mouth closed. and yes dr calkins, children move in and out of the district all year long. are your questions for real?

Holly poses a grave threat to the continuation of their illegally conceived and enacted policies.
