A Revised, "For What it's Worth"

Concerned wrote the following For What it's Worth post in January 2011 (in blue) regarding a letter received from the Harris Beach law firm regarding the Hamburg Educational Ethics blog.  The letter from Harris Beach, dated January 27, 2011, started with the following paragraph,  "We are the attorneys for the Hamburg Central School District (“District”) and are writing with regard to the “hamburgschoolethics” blog for which we understand you created and/or are the blog administrator. It is hereby demanded that you cease and desist from continuing to administer/provide this blog and immediately remove the contents of the blog"

Concerned is certain that the Harris Beach law firm regularly visits this blog, yet is uncertain if it is out of mere curiosity or if the district is actually paying the firm to visit and monitor the activity on the blog.  It is the opinion of Concerned that the blog is being monitored by the district's law firm, and our guess is they are not doing it for free.  So, in addition to the use of taxpayer dollars to sue a teacher, a private citizen and a current Board Member, the district is also paying Harris Beach to troll the blog?  One wonders, where is the money coming from?  Dr. Calkins apparently feels compelled to validate the   outlandish spending spree she, Mr. Achramovitch and others went on at the Harris Beach law firm to respond to the legitimate complaints of people who have exhibited no hesitation in standing up the the district's questionable tactics.

But, Dr. Calkins what about the other $300,000 in legal fees paid to the Harris Beach law firm you failed to mention in your inappropriate letter to the citizens of Hamburg?

Where did that go to Dr. Calkins?

Hamburg Central School Board of Education was there a resolution made at a Board of Education meeting to pay the Harris Beach law firm to monitor this blog?

Perhaps the Board of Education should spend more of its time monitoring the internal affairs of the district, so that the incompetence that was cause for the $1.3 million transportation issue,  the $1.8 million in "missing funds", or the approximate $90,000 plus that was questionably moved to the Hamburg School Foundation does not happen again.


If anyone who reads this blog does not already know, the posts I write are the opinions of this blogger.  Therefore, when I wrote that the "school board violates open meetings laws" it was my opinion because it has yet to be proven in a court of law.  The posts that are titled "from a reader" are the opinions of the readers who sent me the information and I make every effort to investigate the validity of the content before they are posted.  Despite my efforts to reveal the truth, the District hired the law firm of Harris Beach and a lawyer from Harris Beach sent me a letter demanding that I cease and desist this blog.  The letter specifically references my posting about the RSB violating Open Meetings Laws, hence the opening sentence.  The letter goes on to say that they are working with Google to obtain my IP address to reveal Concerned Hamburger's identity.  Also, if I wasn't aware already, I should know that no one on the Internet is truly anonymous.  Readers, I do not know how much it is costing the District to have Harris Beach investigate this blog, but I would believe it is not cheap.  However, the larger issue is when the District is financially strained, why are they paying a law firm to investigate the author of a blog?  Does this investigation take priority over clubs, supplies, programs, etc.?  It it of the opinion of this blogger (for the lawyers at Harris Beach in case it wasn't clear) that the legal issues seem to have increased since Achramo took the helm.  I cannot remember a time when Hamburg used lawyers this extensively.  The RSB must ask itself if all these legal issues are worth it?  Is it worth spending tax dollars to investigate this blog, especially if it means cutting something else in the District?

This blog is clearly within your 1st Amend rights. It is clearly opinion, backed with some great facts. The lawyers are just making a threat to get you to back down, similar to SA's email threat. Those who make threats know they are in the wrong, but try to bully those who try to expose the truth.

They did violate open meeting laws in that classroom at the M.S. as far as we know. And why cant we voice are opinions to one another? If the District does not like our opinions they don't have to read them. You are reading this by choice and you don't know for certain if we are writting our dreams down or facts. Achramos plan at getting Huen to rage out at the last union meeting apparently failed as the blogger wasnt in the room. So, now he is spending money on lawyers. Last time I checked we have something called the Constitution. The District does have a history of trampling on civil liberties and civil rights, but that will all come out in due time. Our Districts own mission statement is :The mission of the Hamburg Central School District is to provide, through a framework of excellence and partnerships between a committed staff and an informed, supportive community, a learning experience that produces literate, adaptable, responsible citizens who have positive attitudes, abilities to think analytically and creatively, manage personal resources, apply technologies, relate to the global community and appreciate the contributions of diverse cultures.
Where do they get off having this as a mission statement? The school Board has done everything in their power to spoon feed us only the information they want us to know about. Is this there idea of “a committed staff and an informed, supportive community “holding closed door meeting and leading witch hunts does not instill confidence or a pleasant work environment. Demanding that a community cease and desist trying to keep themselves informed is an insult …. Keep it up there is more to this whole thing then we are even aware of ….. Not every teacher is doing work at home on a snow day, as a matter of fact, most teachers LOVE a snow day for the very reason they DO NOT have to work.

They don't shut the heat off in the building just because school is closed.

The school district should not be responsible for any accident that happens as you guys make your way to your jobs.

If you are not there, you shouldn't get paid.

So again we are losing focus on the whole point of this blog. I'm sorry that those of you who chose not to go into education are so bitter about a freakin snow day. I have a cousin who is a lawyer, and she receives regular messages as a perk. Am I bitter? No. I could have been a lawyer. Which brings us back to the point.... As citizens we have the right to voice or opinions and stay informed. Hopefully we understand the difference between hearsay and fact, and can make informed decisions. We take our election process for granted. Too many of us vote in May to pass the budget, and "pull the lever" for a school board member w/out much thought. Considering how much of our money thse people are playing with, and the effect their decisions have on the futire of our children, I will no longer take this election for granted. I will stay informed and I hope the rest of you will too.

Concerned Parent 1, if this blog has done one good thing it has give people like you, the hard working taxpayer of Hamburg, the opportunity to take notice of the RSB, Achramo (former: Kerr, Crawford, Roswell and Osbourne) and make them accountable for their malfeasance. They have made a mockery of the government by the people and for the people. Get rid of them, and replace them with people who care about kids and have respect for those who look after them and teach them. Get out there and vote.

Blog isnt the FOCUS....Thank you for the clarifier. Hazelwood v Kuhlmeier was regarding student newspapers, as I think you were trying to say. If Harris Beach et al wanna come after the blog they are going to open one big can of worms that will cast a light on Hamburg Central Schools brighter than the lights on HOWE Field. Then the taxpayer will be exposed to the depth of research that has underpinned the remarks of Concerned. I for one can tell you I have heard from people in the former districts of the superintendent that things with him were not on the up and up....ask a few people from Kenton about the mass email that was sent out or those in Greece to support the remarks of Concerned, and I think you will find more than opinion...it will be something called truth

No one is bitter about teachers getting snow days. We actually all laugh at you pretending you want one so the kids are safe and pretending that you are doing work at home. Teachers are worse than the kids begging for snow days. It is clear that most of the teachers on this blog are not very intelligent and all have degrees from Fredonia and Buff. State, not real schools. Keep us laughing guys.

I don't pretend to want one so the kids are safe. (Although I do want them safe.) Wouldn't you want the day off? I have a fixed curriculum and a fixed amount of days to teach that in. While I enjoy being home with my kids, often snow days cause more stress than they are worth. My performance is linked to my students' performance. Interestingly, I wonder how a banker might feel if their promotion / job retention was based on whether or not someone defaulted on a loan, or missed a payment. As for what constitutes a "real school" - get a life. This sort of ignorance only serves to derail us from the real issues at hand.

I have children work in the medical profession and love when my kids have snow days for their safety so I dont go to work and worry about my kids getting home. So what if the teachers get a day off. I chose to not be a teacher so I work on snow days the teachers deserve the day off. They work from home all year. Anonymous get a life and stop grudging teachers for getting a day off

Class of 78, I would like to direct you specifically to the "In Their Own Words" post, where Concerned Hamburger either has no way of verifying the validity of the documents posted, or, if she does, is not willing to come forward about her method of doing so. Why post the documents at all if there is no proof that they are real?

There is also the matter of the grade fraud posts, in which the statements made are taken out of context, and, in fact, the entire situation is taken out of context. Concerned Hamburger has neglected to provide the whole story. So either she does not have the whole story, in which case she should probably not make assertions when she doesn't have all the information, or she does have the whole story, but will not give all the facts.

Also, not to be a pain, but your first sentence does not make sense, or else I might have responded to it more specifically.

I have done my research, and I think over and edit each of my posts. Furthermore, I think the condescending "young person" remark was unnecessary. The fact that I am twenty years old instead of fifty years old does not in any way make my statements less cogent or intelligent.

A select few the people that comment on this blog really need to get a clue. Complaints about snow days, which are usually 2 or 3 a year, are just petty. Open your eyes and look at what is going on in this district!!!

The BOE and SA wasting taxpayer money on lawyers to represent them in their own illegal actions and some silly investigations, all the while talking MAJOR cuts like AP classes, special education, specials, kindergarten and pre-K! At the same time they are talking cuts like these they are WASTING our tax dollars to pay SA that hefty salary, pay their lawyers, and pay Joan Calkins' sister for her shoddy writing program. This is outrageous! As a parent, I am concerned with decisions that will have a negative impact on my children's education. If the above cuts become a reality, I will be sending my children to catholic school. Anyone complaining about a snow day looks like a fool with all of these serious issues coming to light.

Also, these IVY league and "real college" comments are just despicable and need to stop. In this economy, most families need to choose colleges that are affordable. We can't all make $170,000 like Steve, now can we?

Focus on the REAL issues, people: rebuilding this district by getting some good, honest, pro-student people on the BOE.

well said "wake up". I was at that BOE meeting last night. I am nervous for my children's future education. In all seriousness, how did Hamburg get into this mess? I know that other schools districts are hurting, but nothing like this. We maybe able to "fit" 25 - 30 kids in a class, or 20 kids in a science lab - but does this give our kids the best possible opportunities? The elected BOE and the Super are beholdent(sp?) to the taxpayer / voter. I don't know what the answers are, or even if there is a fix. But our kids deserve a chance at the best possible opportunities. Do we have a super of curriculum? What do they say? Isn't it their job to help make these decisions. Maybe a "town hall" type of meeting is needed to explain some of these problems / solutions to the community in laymans terms. If you are not aware of this blog or affiliated with the district I'm not sure if you really understand what is happening. I think its time that the community and the BOE start working together.

There is NO MONEY.

Pensions are skyrocketing, property taxes are literally through the roof and people are sick and tired of it. After years of public unions buying their way to sweet contracts and politicians making promises they know they would never be able to keep you find our state saddled with the problems we face now. Too bad few people have the balls to do anything about it.

The mess is the fault of the business manager and the Superintendent(s), but most importantly the RSB. Do they every have a vote other tan in consensus? Roll Call Votes, EVER?

Diana - no matter what is true or not true about taxes, the unions, or the district, the bottom line is that our kid's education is at risk. ALL of ours. We need to start thinking outside the box and begin fixing the mess. I don't have the answers or where the money is going to come from. I believe that it is going to be difficult and may take a few years to fully resolve itself. But we as a community need to stop pointing fingers and work together. BTW - can someone explain why Hamburg never opted to have its own transportation department? I did not grow up here, but I'm curious.

So many people would love to know about the meeting behind closed blinds in the Main Office of the HHS. I do not doubt that there are ethics charges on SA, BOE and likely village officials. Elected officials are dangerous when they lose sight of reality, and believe they live on a higher plane than those who send them to office. Shamefully, elected officials on the RSB and in the Hamburg community have ruined innocent peoples lives to aid in a major cover-up which will surface in due time. Someone must ask the HCSD how many legal issues they have pending against them, and how much they have paid to Harris Beach? Let the truth out HCSD...THE BOE and other members of the community will be humiliated!

The BOE did post that they would have an executive or private meeting before the Board Meeting. I wonder what Steve and BOE plan and agree to in these special private meetings? I hope the BOE isn't just eating cookies and joking around about how much weight they have been loosing. I would like to tape these meetings just for personal info and not to spread the recordings but write about them.

HHS Principal was speaking to the village judge in his office. I happen to notice him while at the high school on 2-1. He reduced my speeding ticket to a parking ticket, so I recognized him. I didnt go to the BOE meeting I was at high school to get my child. I wasnt aware of whats been going on until my neighbor sent me a link to the blog. Maybe Mr G got a ticket and the judge is making it go away? I am now curious....what is going on?

Harris Beach was wrong. the HSCD was in violation of the FED/STATE OPEN MEETING LAW. As decided by the NY State Supreme Court, not once but on numerous occasions in violation of the laws.

Well the district was wrong at the time and so was Harris Beach.

Vetern members of the board unaware that the laws even existed. This secrecy and lack of transparency is what led this district into this financial disaster. Anyone involved should hang their head in shame as to what has been done under their watch to our School District. Former teacher/ alum

Let me get this right, on the tape, Joan, Paddy, Matt, Greg, Stevie, KC, Kelly and Diane lie about two teachers, ignor the documented FACTS that grades were made up, and DOCUMENTED facts that it affected the top ten in the class of 2010, they claim they have affadivits from the VIllage Police, and the local judge about two teachers, they joke and mock Sally Stephenson, mock and joke the the teacher union is a bunch of dopes, and the two teachers who have been brutally attacked by the gang of thugs are being sued??? Is anyone concerned the gang of thugs are running the district. No wonder Kelly Harper resigned, that former BOE Pres and meathead Wichlacz and Neyman didnt run again.
