"Hamburg, New York where the United States Constitution doesn't matter. "

Concerned Hamburger was recently sent the following information (blue below) regarding private property rights and other attempts of Constitutional rights tampering by the Town of Hamburg.  

So it seems that the governments (town, village and school)  of the Hamburg will just not quit with attempts to thwart rights guaranteed by the 4,400 word United States Constitution.  Readers may not agree with the message of the signs on the South Park Avenue fence, but this man has the guaranteed right to say it, even if you don't like it.  The content of the message is not the matter of dispute. The contention is that the Town of Hamburg is using the color of the law in an attempt to willfully deprive or conspire to deprive this Hamburg property owner of rights protected by the Constitution. 

The actions of the Town of Hamburg shocks the conscience.  

You have now entered the Town of Hamburg- silence yourself  and leave your rights at the border. 

The Town of Hamburg, NY, a suburb of Buffalo, has issued a summons for violation of a sign posting ordnance to a 58 year old retiree and SCOPE member for posting anti-NYSAFE signs on the fence of his residence. The signs have been posted near the intersection of South Park Ave, and Scranton Road, a major thoroughfare in the Town, and have drawn the attention and support of many people.

After being harassed several times by a local Code Enforcement Officer (Building Inspector) the resident was mailed a summons and ordered to appear in the Town Court on February 21, 2014. The resident told the code officer and Town Officials that he was exercising his First Amendment rights to free speech in posting the signs criticizing the NY SAFE act. He also cited a 1994 US Supreme Court decision (Gilleo v Ladue) which prevents municipalities from regulating signs on private property with noncommercial messages relating to the exercise of free speech.

The home owner appeared in court where he was given a postponed date to hire an attorney and appear on Friday, March 7th at 10:00 AM to answer the charges.

Any interested persons are invited to appear at Town of Hamburg Court 6100 South Park Ave. Hamburg NY 14075 on the above date in support of this man. The gentleman, a former Republican committee man, believes that the summons is politically motivated by local party officials who are unhappy with the positive responses being received with the message signs against the SAFE Act. The signs, having been posted since August of 2013, were only written as a violation of the Town Ordnance after a new Town Board took office on January 1st, 2014 with a 2 to 1 Democrat majority, the previous majority having been 2 to 1 Republican.  The prior Town Board did pass a resolution in 2013 condemning the passage of the SAFE Act.

Any concerned citizens or gun owners, or those supporting the Constitution and the right to free speech, are urged to contact the Town of Hamburg Chief Code Enforcement Officer, Mr. Kurt Allen at 716-649-6111 Ext. 2210 and express their opinion of this action. 

Concerned persons are also urged to call the office of the Hamburg Town Attorney John Jordan who is prosecuting this man at 716- 649- 6111 ext. 2370 to express their outrage regarding this matter.

Cheryl Potter-Juda appointed her nephew, Robert Barnashuk, to the paid position of Town of Hamburg Planning Board attorney. Prior to the vote, Ms. Juda was questioned at the Board meeting on her relationship to Mr. Barnashuk and if he was a resident of the town. While attempting to deflect the question, she finally admitted that he was her nephew and that he was a resident because he was living on her couch in her Briercliff home. She then refused to abstain from the vote boldly suggesting that there was no conflict of interest in voting her nephew into a taxpayer funded position. Following his appointment, Mr. Barnashuk attended one meeting as Planning Board attorney where he refused to answer questions regarding legal issues pertaining to a proposed project. At the next town board meeting, it was announced that he had resigned from the position and a replacement was voted in.
A similar situation also took place where Ms. Juda appointed her friend, Stephen Mikac, a retired assistant police chief, to the position of Superintendant of Buildings and Grounds. Mr. Mikac's appointment was also questioned regarding his lack of qualifications, his lack of civil service testing, and his current involvement in a lawsuit against himself and the town. Against the town attorney's recommendation, Ms. Juda voted in Mr. Mikac to a position that paid $24,000/yr., while removing the previous person who was only being paid $2500! Mr. Mikac also resigned from that position in under a week.
And we thought the Hamburg School Board was screwed up? The Town Board is even worse!

Let Rick Jetter suggest the cuts isn't that what the taxpayers are paying him for? How much is Rick Jetter being paid? I heard that Richard Jetter suggested that the HTA suggest the cuts. What a way to go Union suggest who goes and who stays. Sorry Amy not a wise move

Yoviene and Flynn dont have college educatitons. Patti lied about hers, she said she has a BA from Brockport- never happened. Laura Heeter had an education degree, and was a teacher out of state put had her license pulled because she was screwing a PTA DAD who was stealing money from the schools. From what I can see the only ones with educations are Holly, Sally and Cat. Maybe thats why the others hate them...they have brains. Of course, they are women too. Sure beats Chiacchia's Cs in Law school.

JAmes Martinez Boston Valley and the lies he tells sure will cause a lot of problems for people. Its like little children when they think they have gotten away with something. Consequences often lie in the future. The wheels of justice grind slowly. As the Village Judge, he'll tell ya the Judicial Ethics Committee does make decisions, just not when you think.

Dont you see it, its Dan Chaicchia- who defamed the kind and wonderful Mr. Tresmond, and the he moved on to others with the ultimate target of Vicent Coppolla. Curious case of Daniel Chiacchia, HTA President, and Superintendent killing the extended school day for all our elementary school kids. Why because Daniel CHiacchia says so. Daniel Chiacchia in his CIVIC MINDEDNESS (joke) has no children at the elementary level. His kids go to a private prep school in East Aurora. What are they denying our young children. A shorter elementary school day, E Aurora, O.P. W. Seneca, Lake shore, Collins, Eden, Buffalo, all have a much longer elementary school day. In there SELFISH AND SHORT MINDED BEHAVIOR THEY ARE DENYING ALL OUR KIDS THE CLASSROOM TIME OUR KIDS DESERVE. Selfish, greedy, self serving.

Dont worry longer school day, when dumbass Rick Jetter finally lets the teachers know that 20 of their jobs will be cut in 2 months, they will wish they did have a longer work day. Umm, the HTA President is a el ed teacher, so lets figure out why no longer school day? Get used to this shit, Don Ogilve has been running the district like this since he and Pete Roswell paid off Cliff Huen with a 90K job that he worked 1/2 days. Really, maybe someone should go after that theft. What Don doesnt realize, is he has pissed off many many many people in his sleazy amoral actions, and those on the short end of his stick are getting to know each other. And oddly, stories seem to mesh.

Daniel Chiacchia & Cheryl Potter- Juda picking up where Collins left off. Free expression and free speech only when it comes to their dirty politics. Let Scott alone he has a right to his public expression. Stopping Scott because you don't agree with his politics is wrong on all levels of decency.

We are becoming a town of intolerance and gestapo type politics. Town and schools.


Our elected officials on all levels should SERVE WITH COMPASSION not this bitter behavior. Life long resident and thank full for Scott and his families life long service to our volunteer fire company. Thank you Scott, God Bless your family many wish you well in our community. Old friend
