Richard Jetter's contract: NO BUY OUT CLAUSE

Channel 4 WIVB Senior News Reporter Richard Newberg reported on Monday July 28, 2014 the costs of the Richard Jetter contract and the hearings of Catherine Schrauth Forcucci  (later post).

Mr. Newberg reported on Richard Jetter's contract (Jetter's Contract) which was approved by Hamburg Board Members Flynn, Collins, Yoveine and Heeter.  Board Members Stephenson and Forcucci each voted NO on the contact, and former member Balaya was absent for the vote on March 11, 2014 (March 11, 2014 Hamburg School Board Minutes).   The news report revealed that the Hamburg School Board has few options when it comes to "firing" Jetter.   The "buy out" clause which is standard in most superintendent's contracts is absent in the contract of Richard Jetter, which was approved by a split board of education.

Doctor Jetter has a 5 year contract and the only way out is a lengthy hearing which will cost the Hamburg taxpayers dearly.   Doctor Jetter's contract will cost the taxpayers well over $825,000.  Those who vote in the affirmative on Jetter's contract hung the Hamburg taxpayer out to dry.

Channel 4 news questioned Hamburg School Board President David Yoviene about the contract and he stated that the clause in Jetter's contract is misunderstood and he referred the matter to the Hamburg School District Attorney Andrew Freedman.  It looks like the only one that misunderstands the contract is President Yoviene.

Hey President Yoviene here is a news flash:  Andrew Freedman wrote Doctor Jetter's contract, did he not?

So, why the heck do you need to refer it to lawyer Andrew Freedman, so he can clock more hours to review something he wrote in the first place?   How is that for spending money, Hamburg taxpayers?

If one is to review the Hamburg Board minutes from March 11, 2014 it is pretty clear that Yoviene and Flynn had little interest if any in discussing the contract and the minutes reveal that some board members had little time to review it at all.

In the March 11, 2014 board minutes, it is recorded that David Yoviene stated that Jetter's contract is very typical of other superintendents in the area and that Hamburg got Doctor Jetter cheap compared to Clarence, Orchard Park and Lancaster.   Yoviene stated, in the end we chose the guy who could handle the dysfunction.   Yoviene stated Jetter is one of us and part of our family.   Flynn echoed Yoviene's remarks, and stated Jetter's package is in line with the job of running a $60 million corporation.   The minutes of the March meeting reveal a cocky Jetter who claims he conceded to a salary of $164,000.   Jetter mocks the district and says he measured his experience to date in dog years.

The most revealing remarks made by David Yoviene were as follows, "the last superintendent had a buy out clause in his contract.  If the last superintendent was to leave, we had to pay him a full year's salary.  There is NO BUY OUT CLAUSE in Dr. Jetter's contract". (March 11, 2014 minutes Read pages 48-50)   So Hamburg taxpayers are you going to be on the hook for Doctor Jetter's 5 year contract?  Hang on to you wallets Hamburg; Yoviene, Flynn, Heeter and Collins hung you up for over $825,000.  

Here is an idea Hamburg School Board Members:  create a policy that requires a unanimous vote of all 7 members before any superintendent or staff member is employed.   

In reading the minutes it is clear that the self proclaimed "civil" members of the Hamburg School Community were on their worst behavior.   Booing, jeering and hissing at members who questioned Jetter's contract.

The March 2014 School Board Meeting ended with the sounds of  self-proclaimed voice of the people and "Hamburg Guy" Dan Chiacchia complimenting Boston Valley Principal James Martinez and Hamburg Superintendent Richard Jetter for their leadership and courage.

Someone please inform: what is "safety officer" Martinez's role in all this? Surely he is somehow involved. Why would he be put in charge of an nice elementary building proclaiming he was sent there to "fix" it when he is nothing but a bully and tyrant? Anyone have any info on the fake break in from last year?

Wow. $200,000 spent by Yoviene to nullify the results of the community election just because he doesn't want to work with Forcucci because he sees her as associated with his arch nemesis, Stephenson.

The school district is cutting left and right and elementary school class sizes are huge, and Yoviene and Piazza and their faction are wasting hundreds of thousands of the kids' dollars on a personal dispute.

The state should be asked to audit the money spent on these juvenile and embarrassing hearings, and maybe Mr. Piazza should consider paying for them if he wants the hearings to continue. No one I know in Hamburg wants anymore of this circus, and we shouldn't have to pay for it.

Dave Yoviene could end up in prison, or at the very least with some big ass felony charges against him. Yoviene is "buddies" with k. Fisher. BTW, who did pay for that bus at the Jetter Rallty with the Hamburg Teachers Banner on the side. And where is the UNION president, we hear she is under investigation too...sleezy.

Martinez and Jetter claimed that someone tried to break into BVES one weekend, yet the security cameras were turned off. Only Jetter and Martinez had the code to operate the cameras. And what's weirder is that they never even called the police! They just accused Catherine & Sally out of the blue. NOW WAIT A MINUTE-You'd think that the police would have been called the very 1st thing. Wouldn't you? Why in the world were the cameras turned off for only that day at BVES, and no other school in the district? And what the hell would Catherine and Sally possibly want with anything in that school? SERIOUSLY, REALLY? Jetter's credibility is already down the toilet. And Martinez is probably next. John Borsa (ch.7) has been interviewing around about him for several days.

Danny Baby sure must have a lot more to do with his brother facing FELONY charges in Florida. Danny Baby actually brought his brother Darren to one of his community hate sessions last fall. Darren skip a court appearance in Florida and was arrested in NYS in June. Danny represented his bro in front of Judge D'Amico. Now Darren is back in FLA facing felony charges of having sexual intercourse with another man, Darren did not share with his sex partner that he is HIV/ AIDS positive. Danny has a lot on his plate and sure does like to point out other peoples short comings. Hey Danny why dont you tend to your own knitting needles and leave Hamburg alone. How embarassing it is that a noble upstanding community member such as yourself, who kindly represented Cara Dickey the child rapist teacher from so. Bflo Charter School, would have the balls to point the finger at anyone. Do you have a screw loose?

This is ridiculous.
Why should the school district have to pay Dr. Jetter almost a million dollars after he broke the law? It seems as though filing a complaint with the State Education Department and revoking his certification is the way to go.
No certification= no longer qualified to hold the position.

It would be really great if someone or a group with resources could put a petition together saying simply that, regardless of our political affiliation, if any, we don't want any more tax dollars spent on the Forcucci hearing and that we want the board to drop its focus on interpersonal differences and return to the business of running the district. That personal differences do not warrant spending hundreds of thousands of dollars of taxpayer money intended for the children on this hearing in light of the education cuts the district has had to make.

I bet hundreds of people would sign that petition just to send a message to these board members about their priorities. And it would show that Piazza's little faction is just that--little.

Dear Concerned Hamburger

I agree with the other commenters this has been my only source of information in the Jetter Affair Scandal. Thanks, but some people are pretty low case with the things that they say about some people. I say who cares about Dan Chiachia, Cara Dickey or Darren Chiachia? They are no bodies in our schools. What bothers me deeply is the status of the Hambrug Human Resource Manager Lorraine Simonick, or Libby as we call her. I dont know her, only the stuff she sends out to the staff from the main office. But, I was looking at the contracts on the district webpage and I noticed that she has a contract with the district to work part time (.6 FTE) and make $41-42,000 per year plus $2,300 per year on top of that. She gets her health insurance paid, vacation time, sick leave, pay for unused sick time at $120.00 day, and all kinds of other sweeties. Not a bad deal really, for a part-time employee. BUT HERE IS THE QUESTION THAT MUST BE ANSWERED. I HAVE BEEN IN HAMBURG A VERY LONG TIME, AND MAKE NO WHERE NEAR WHAT LIBBY MAKES ( I AM NOT COMPLAINING).

In 2008, Loraine Simonick retired and according to See Through NY she makes $46, 253 in a NYS Pension from Hamburg. Check it out for yourself. Its on See Through NY under employee pensions. So, if my math is right, which it has been known to be off, Libby is making almost $100,000 off of Hamburg (retirement plus current contract). Now, I know Lib has been around for almost 40 years. But this is unreal. Does she know something about the district that no one else can know. I am not sure whats going on here, but I know this is the only place I can bring it up. Is this another one of Jetter's pay off schemes...like with his secretary. Me and a lot of other people know what Jetter did. He gave special favors to people who did his dirty work- better schedules. better classes, more money and others stuff. Sadly some of the morally absent people we work with took him up on his offers and now what are they gonna do? I say end these hearings NOW, hire someone new in Human Resources and drag the dirty staff members out into the public. I know 3 ladies who should be fired for what they did, and two are substitute teachers in the middle school. Hopefully the new superintendent will make things right, but I fear, I know this scandal goes very deep, including the HTA. Oh well, glad my hands are clean.
