You just can not make this sh*t up.

One must question the mental health of Superintendent Cornell and the Boars of Education.  In a recent document, the Hamburg Central School District stated that the budget is $1 million short for next school year 2016-17.  Two days after the announcement of teacher cuts and shortages of money, the same people met and decided to file a lawsuit against one of the teachers in the district.  It is clear, Cornell and the Boars feel the attorneys at Hodgson Russ are more deserving of your taxpayer dollars than the children of Hamburg.

It seems that delusional behavior is a pre-requisite to sit on the Hamburg School Board.  It no secret, that the Boars reached down to the bottom of the barrel in desperation when selecting Michael Cornell to be Superintendent. The truth of the matter is, no one wanted the job and Cornell, much like Doctor Jetter, would do anything to become a school superintendent*.

So just hours after admitting the short fall of $1 million, and recommending cuts in staff, the district filed a lawsuit against a teacher, who recently was victorious in a disciplinary matter.  Concerned Hamburger was notified that the judge who presided in the matter stated the district's actions against the teacher are a "sham".   So after a grueling defeat the boars turn around and claim fowl play and sue the teacher in NYS Court.   Money is no object for these folks.  The ten days of hearings held at the Embassy Suites on Delaware Avenue in the City of Buffalo cost the taxpayers of Hamburg in excess of $250,000, and it isn't over yet.

One has to wonder what the heck is going on here?  Cornell, who was in the district for only 6 months, and who allegedly never met the teacher in question, made up what is said to be quite a story of missing lesson plans from 2013.  Concerned was told that Brent Jordan, Michael Gallagher and Colleen Kaney testified about the missing lesson plans, but none of the aforementioned over paid administrators witnessed the absent lesson plans first hand.   The hearing officer called Jordan untruthful, and when questioned Kaney had to admit in testimony that she never  ever had any conversation with the teacher in question.   It was revealed, that Cornell, Jordan, Kaney and Gallagher, each making well over $125 K per year spent ten days sitting around a hotel room in downtown Buffalo waiting for their turn to lie under oath. **

The case amounted to a whole bunch of hearsay, and a considerable amount of prevarication.   The case against the teacher is so wacky, the hearing officer blasted the district in the decision, and now the Boars are crying in their tea.

Fear not Hamburg taxpayers, you will continue to fund the attacks as the district is using your money to run the meter for  at least  10 lawyers at the Hodgson Russ law firm.

* including the dirty work of CHA and his pal the not so honorable Andrew Fleming.
** CH was told that on one of the hearing days, Cornell arrived at noon for a 8 a.m. start, 4 hours late.  His excuse, was that his wife won a Wegmans gift card on the radio and he had to go grocery shopping.  The real irony is Cornell accused the teacher of not doing their job, and then he spent half a day doing his Christmas ham shopping at Wegmans when he should've been at work.    What a loser.

Lookie what Cornell says, "“Instead of spending taxpayers’ money on legal fees, the district should be using that money on programs to help Hamburg’s children,” Cornell said. He said this in the Buffalo paper. Is there something wrong with him. The superintendent brings charges against a teacher and Cornell knew very well that it costs money now he is saying they shouldn't spend it on tax payers. Well from what I can see, the teacher has a huge lawsuit against the district for the abuse. If I were her I sue them and make it real painful for Flynn and Heeter. Tom Flynn is driving this bus. Flynn hates teachers, unions and esp. Kavanaugh. Heeter is out of her mind, and the other bozos are too new and dim to figure things out. Shame on them for spending this kind of money and let me tell you there are more than one teacher who didn't leave lesson plans. I thought for sure the HTA said that our lesson plans didn't have to be the big long thing that no one uses. So why they going after her? I read the papers and its crazy shit. I hope the district has to file bankruptcy for there actions. What a sorry bunch of assholes.

In the name of God leave the woman alone. The judges decision will come out just in time for the budget vote. You think I am giving these guys one more cent of my money. VOTE NO ON THE BUDGET.

Another legal battle brought to you by Tom Flynn. Isn't he the one that had a temper tantrum when the Board dropped the taping lawsuit against Kavanagh. Look we all know whats going on here. Cornell really? You actually think people believe your tale of blaming the board. Really? How dare a superintendent play the board and then ridicule them in the Buffalo News. Update your resume Mike, stormy weather ahead. Heard Flynn is on tape saying he will spend every cent in the district to get her. What a terribly evil man that Tom Flynn is, and who on earth would trust the perv around kids?

Flynn is doing this because Dan Chiacchia's little pecker has a hard on for the teacher. Cha's microscopic pecker gets all worked up with school board stuff. Cha tells all at his little cagger events. Funny a little midget with a failing law practice gets his kicks bossing the drunk Flynn around. Cha the guy who represented Cara Dickey, who also liked the littler peckers.

Why hasn't the Buffalo News or this blog written about the petition filed with the Commissioner of Education to have Cornell and the Board removed for failing to provide a student with due process? So lets see the Board and Cornell do whatever they want to students and teachers and then spend millions with the lawyers. Ya think there is a problem here? Ya, I bet it Chiacchia too. Remember those meetings he had with that other micro-man Ed? Why don't people stand up and say NO MORE? I'd ban Chiacchia from district property, he is a real pain.

But no worries, Hamburg administrators will continue to receive hefty pay increases each year during the next upcoming contract negotiation. Totally justified because they do such a great job at leading the district to financial ruin.
Maybe Hamburg needs to be part of a pilot program to overhaul board structure-- maybe more votes by community members when any item not directly related to the education of students is discussed. It needs to be made much more difficult for the board to wage these legal wars.

And this is all over lesson plans?!? The district does not have any specific requirement for teachers to write lesson plans on a day to day basis. And asking teachers to write detailed plans is a joke for the days they are out of the classroom-- most periods end up as study halls because the district "can't find" (or hasn't done enough work to find) enough substitutes to cover classes. And the subs that do occasionally work in the district choose other schools first because they end up with no breaks or lunch if they come to Hamburg.

Maybe merging with Frontier would help to oust some of these ineffective administrators and board members.

Something needs to change...

Let's see... I am pretty sure the district just opened itself up
To a major liability. No one is required to write lesson plans when you are out sick- unless your Kavanagh. Her suspension is illegal and when the dust settles Cornell will run alway and the taxpayers are gonna be paying a heavy bill. And I wonder about the other teachers who missed open house. I can name atleast 5. It's not in the contract. Heck I've missed it a few years. Work while out on a illegal leave? Really? Those board members treat MK different than anyone else. And ya think everyone doesn't see it? How bout Martinez? They spent twice this to defend that dangerous man, and Giallella- sleeping with Jetter and aiding and abetting a crime. On and on it goes. Givem hell MK.

So, the teacher is charged with misconduct? The hearing officer finds the district was bullying the teacher, which they've been doing for 6 years after they fired her friend. The BOARS- lol- seek to get her fired for not handing in lesson plans that she admitted she didn't do because she was out sick (don't we have emergency plans in the office? And when other teachers don't leave plans the other teachers as a professional courtesy help out, right?), she didn't go to open house ( lots of us didn't don't you remember they tried to make us do a make up?) and whatever else I think we've all been guilty of. The hearing officer see right thru the bullshit, calls the district out for bullying the teacher and now the district crys that the hearing officer is guilty of misconduct? Well it seems to me that the superintendent and the BOARS-lol- are guilty of misconduct, and from what I heard and read in the legal bills seems like the lawyers are guilty of misconduct- didn't the spy on the teachers house using DIGITS? Well, any of us who have been around long enough know one thing for sure- if anyone is gonna get too the truth of the this it will be Kavanagh. What the F? Why would they every start all of this all over again. Here we go.... Right on 5:38 AM- Give them hell, MK!

Another embarrassing superintendent. Don't they have anything else to do. Is anyone suprised they came after Kav as soon as Stephens got off the board. They waited almost 3 years? Its obvious Chia got his cronies on the board to go after her because she got her partners ass in a jam for his dishonesty. I heard the ethics folks are looking at Chia and Fleming again. This time the shit will stick so is the talk with some people who know. Yeah, more embarrassment is on the way, thanks you idiots. Meanwhile, didn't the HMS principal sleep with Jetter and cover up his lies. Why isn't she on the front page of the paper? Lesson plans..this is unreal.

Isn't there any way the community can express outrage other than through this blog? Start a petition? Make a bigger demonstration of the disgust with spending tax payer dollars on ridiculous lawsuits instead of student needs. Hamburg kids have fewer educational resources than many area school districts-- all of this ridiculousness by adults saying they got their feelings hurt and were bullied is having a serious negative impact on our students... You know, the kids... The people the board and administrators supposedly care about.

No wonder enrollment numbers are dropping in Hamburg... But then again that is exactly what the board wants-- more excuses to get rid of teachers and continue to wage their self- serving legal battles.

Hamburg needs a violent overthrow of administration...

Gallagher actually testified? He wasn't even in school in Sept 2013. He should talk about misconduct. He passed every single senior in Economics in 2014, because he wanted graduation rates up. He gave grades out to AP kids in 2010. Casey Young in Buffalo might lose his job for this kind of thing, so where is State Ed for Gallaghers misconduct? He and Jordan, and Martinez have been fiddling around with test scores for years. Everyone knows that Boston Valley is NOT in the top 20 elem schools. Gallagher should lose his license for making up grades and he points the figure. Anything to collect those paychecks boys. Cant wait to see this play out. Pass the popcorn please.

This school board is not going to hold administrators accountable for passing students without merit. That is how at least one board member's kid got through high school- by phone calls to the superintendent to change grades.

After reading the Article in the Buffalo News I feel sad to be s part of the Hamburg community. The district had trumped up "charges of misconduct" to something that negatively impacted students-- not their perceived gaffes over missed paperwork. I feel bad for Kavanaugh that she had to go through this. It is absolutely ridiculous to try and fire someone over missed lesson plans, not going to open house and giving someone the wrong copy of s test to use. How absolutely absurd. Where were the "misconduct" charges when a Hugh School administrator didn't print exam response books for 350 juniors when taking the ELA regents exam? Where were the misconduct charges when important paperwork is consistently misplaced by Hamburg Administrators? Where were the misconduct charges when every single administrator is out of the building to attend "engagement training" and students are running rampant through the building? Hamburg needs to get over itself and start doing what is best for the kids. Where are the misconduct charges when administrators don't "get around to" writing recommendations for students and staff, don't respond to concerns in a timely manner, refuse to provide appropriate services to special education students because of "budget issues" and completely fail to schedule students appropriately for classes?

Talk about setting a bad example for students... If you don't like the way something is going for you sue,sue,sue,sue...

The administration has been brutal to Martha. She has nerves of steel to but up with this crap. Where's the misconduct when tom Flynn gets so drunk at kissing bridge he can barely stand and then gets in his suburu and drives under the influence- a regular occupancy. Where's the misconduct when a male teacher punches a kid and tells them regularly to F off. Or the Hills and there misconduct? It's a regular occurance when Derek throws a desk- and enters a female teacher class and berates her. How about the inappropriate conduct with students- lots of "personal" relationships. If I were Kavanaugh I'd tell the hole bunch of them to suck lemons. Not sure where this is going but I sure hope she keeps her head high. Where's the HTA on this? Odd the membership has to read about it in the paper. But then again we know some of the teachers are just as bad as the administration. I am so embarrassed by these administrators. Brent Jordan is literally an idiot, he has no integrity and would t know the truth if it hit him on his fat head. What a asshole.

hilarious... It didn't take the hearing officer too long to figure all this out. The Board should be embarrassed at their actions and stupidity. And how about the really bad legal advice that Hodgson Russ is giving. Bring back Mr. Tresmond... Remember the haters chased him out of the district so they could bring in the unethical Andrew Freedman and a fleet of lawyers who have give really bad advice. So is that how it works, McFail fails from her bad advice and then charges the district more to make more bad decisions. Has anyone file complaints against these thieves? No wonder young parents don't want to be in Hamburg. The scum of the earth Board is wrecking the district. Bad decisions all around. M and T Bank should investigate Flynn. If he is so unethical on the board can you imagine what he does at work? He has access to private information and money. Is he drunk at work too? Lots of questions here.

Flynn sure is the driving force for his pal & campaign financier Dan Chicchia & Andrew Fleming. Way out of line & how many cuts are they going to have with staff because of Flynn's & Chicchia's feud with Kavanaugh? Time to redirect back to what u r elected to help kids. Transparent that these two lawyers funded all the sb campaigns. Laura Heeter how about the kids. She sure has totally lost her focus.

A dysfunctional board. Who can the board blame now for its insanity. Sally, Holly and Cat are gone, and who is left? Lets see, the insane Tom Flynn. HE is the only constant in the vendetta against Kavanaugh. Lets see- Andy Freedman and his old law partner unethically broke the law when they removed Forcucci. Hoover tattled on in his decision for almost an hour on stuff that was in testimony- that Hoover got when he was chasing around Mahoney. Hoover is a dirty thug that did Donnies dirty work at BOCES. Any who..... when Forcucci appealed the unethical actions of the liars- Heeter, McNamara, Martinez, Lackie, and crazy eye Jetter, the boars called said, just move on CAT. And it seems like the STATE ED folks are in on it too...wheres there decision? So, now, after the BOARS berated Forcucci for appealing....they turn around and appeal a decision made against them by what seems like an enlightened hearing officer? Whats good for the goose is good for the gander. Who can the BOARS blame their disfunction on now? Where are the Whipples with their pitch forks and prostitutes screaming for the law firm to step down. They don't call her MCFAIL in labor law ville for nothing. And as for Freedman, he has already demonstrated he has no ethics. Can wait till this plays out in court. So, if the district wins they are gonna spend another 250K on another hearing over lesson plans. really? what idiots.

Cornel should've stayed out in Amherst. He is going to go down for this one. The Board is going to lose this case, and the teacher is going to have one whopper lawsuit of defamation and God knows what else against this board and Cornell. You know, they think they will be indemnified, so they can act with reckless abandon. The NYS Insurance Reciprocal Representative Greg Hawk really needs to stop talking about Hamburg. He said the district had a huge liability because of all this stuff. They wanted to hire that Jodi Briandi, of Hurwitz Fine cause she will do anything. I heard she was the one who first hired DIGITS to listen in Mahoney, and Danny THE SHORT got in on the DIGITS game. Oh heck, someone stop pour Greg Hawk drinks...he's a chatterbox. Lets see who's gonna win this game---- I am betting on no one. What about the kids? Cornel could give one bit, and the insurance rep for the district knows this is gonna go south real quick. Where is Danny The Short?

"Sub Plans: Clarified with district that detailed sub plans are not necessary. Union has asked district to look into what other districts do regarding sub issues. Subs were a hot topic at ECCTUP (local presidents). A couple of districts have worked an agreement where members are paid a stipend to cover a class, with first two occasions gratus and stipend given after that. Sub folders: District agreed it is unrealistic to put day-to-day plans in sub folder. General, emergency-type plans are fine." Am I missing something. I read the charges, and the testimony off the internet. Are you telling me they charged K with not having full blown out lesson plans, but our union has published the above comments in our minutes where the administration says you don't need full lesson plans. So, can someone please tell me what the hell is going on with this crap? They are going after a teacher over the lesson plans, but are telling the rest of us we don't have to do them. Can someone please comb thru this insanity? Why are they treating K differently. Oh I know, because they have for years. Wow, and where is the HTA? Oh yes, Amy is an idiot. I guess that answers all the questions I have. No Lesson Plans NEEDED unless you are MK? IS THAT IT?

Based on numerous conversations with teachers in the district who have gone out on leave for a variety of reasons, the district provides little to no guidance on the expectations of the classroom when they are to be out on an extended leave. The district does not have any set guidelines to indicate what type of plans are to be left or for how long into the absence.
The district also does not Use the NYS require forms for FMLA and Only asks for a doctors note.
They are making this huge deal about a teacher not submitting detailed lesson plans, but no waves were even made when Gallagher was out for medical leave for months and many things were brushed off- including student discipline- in his absence.diuble standards abound in Hanburg. Time to clean house with admin and the board.

Flynn called Kavanagh the "poster child of the Cuomo reform agenda". His remarks about her are on tape and filed with atleast 3 agencies that are investigating the district and the lawyers who tried to go after her for complaining when James Martinez made up a story that a gun was coming to school. Martinez lied to June meisner about her daughter, Jordan created a trumped up safety plan, lied to a kid and made a safe haven for her in Matthew moscatos classroom. Meanwhile, Amanda Bolin in her stiletto pumps and sick diving neck lines was going into classrooms getting phoney petitions trumped up against er her. Madam whipple and holly darling got their daughters to lie.... And Colleen Kaney created False paperwork. Then....there's more...for later. They are so stupid- their little plan got derailed because CHA is well insane. And then they make up lesson plan offenses. Meanwhile MK is out on a medical. Maybe some should ask Nahrebeski and Palma the sour pusses who lied to boces. Can anyone say cover up? It's all coming down- and the district fools just made it worse.

The village was buzzing this morning with the news of yesterday. People are very upset with their taxes and the fact that the district is losing money every year and spending more with the lawyers. Every single person said they are voting NO on the budget. We feel fooled by these guys on the board- they said they were going to restore sanity? They are just doing the business of dan chichia (?) in secret. Everyone now knows why that guy is so interested in the Board- he is out for that teacher and all the answers are now clear. Shame on those guys who are stealing money for the kids to go after the teacher- what is wrong with these guys. Are they not getting any action at home? VOTE NO ON THE BUDGET!!!!

7:24- don't forget about Nahrebeski leaving her class unattended and going to the village police to see that dirtbag Melisz to file a fact police report. Boo boo Beckey thought people were staring at her and she was being followed. Can we have the paranoia checked out in a 913? It's just wild. Beckey now thinks she's a union steward.....? A sad sack blump bully who never left middle school conduct. She was a bully then and she is now. Howdie

The really criminal part of all this is that these so-called charges against MK were prepared at great taxpayer expense by the law firm of Hudgson Russ. They are not new to education law and they knew these charges are not nearly enough to dismiss a tenured teacher. But ka-ching, ka-ching, they did it anyway and billed the district accordingly. If this is the kind of legal advice Hamburg taxpayers are paying for, then we got ripped off!

So true 11:17 AM. Now extend that concept to what they did to Forcucci. Don't you see it? Andrew Freedman ( who is on tape disclosing confidential information about a Hodgson Russ client- in the private sector- to a board member. Freedman disclosed information he was told by another greedy MO FO attorney- and disclosed it. With any luck the tape recording will take Andrew and his beaten shoe leather off the streets and put him in a Starbucks as a barista. He has no business teaching or practicing law. And as a former student of his I can tell you first hand- he was the worst instructor ever. And allowed students to cheat on his final law exam. ITs all TRUE!!! We he was told students- who by the way were studying to be a school administrator- and Mike Cornell was in the class All TRUE- were cheating and sharing answers on the final exam, he said he knew and everyone got an A. And this was a Canisius College- A Jesuit School) So, when Andrew attacked Forcucci- literally attacked her- and then had his pal and former law partner ding bat Dave Hoover preside over the case. They spent several hours in executive session trying to convince stevenson to go along with there sick shit. WHY YOU ASK? Well, its pretty simple. Harris Beach Legal Bill, DIGITS, Fisher Buss and the dire need to Danny CHA and his pal Andy. They have been doing shady shit for years, and the people of Hamburg allowed Danny the Short (thats funny) to change the channel of public discourse against those who he knows were on to the deep pile of dirt. He had 5 public hate session set out to besmirch Stevensons, Balaya and Kavanagh. Funny, he never talked about anything else. Oh, maybe Mr. Tresmond- because he'd never go along with this filth. But the 20 or so lawyers at Hodgson Russ- heck they don't care along as the bills are paid. You have a real problem- and it starts with that law firm on So. Park Ave. right then.

Anonymous said...

11:17 3/25 Yeah and Hodgson Russ is making a bundle giving out super bad legal advise. But do they give a crapolla about our kids in Hamburg? NO. Seriously? Lesson Plans when someone is out sick? Is that not the craziest thing you've heard? I asked my kids about subs- and they say they are lucky to even have one and somedays when teachers are out they have aids and hall monitors. So, why is this happening to that woman? Id say that they have really caused a big uproar over not a big deal. Word is they just don't like her. Well too bad Mr. Cornell, I don't like you. You are a cocky jerk, and even the students say it. Go back to the Northtowns and blow their money!
